Volkswagen Snapshot 2024

Please read these Terms and Conditions carefully prior to participating in the VW Snapshot Competition (Competition). The Competition is organised by Volkswagen Group Ireland Limited trading as Volkswagen Ireland based in Block C, Liffey Valley Office Campus, Liffey Valley, Dublin 22, D22 CF60 (VW Ireland). Anyone who participates (Participants) in the Competition fully and unconditionally agree to these Terms and Conditions. ‘Entry/Entries’ refers to a photo(s) entered into the Competition via the instructions above.

1. Participation Period: The Competition is open for participation as per the timeline. VW Ireland reserves the right to alter the Opening Date, the Closing Date and the Winner Announcement Date.

2. Ownership of Photos: All Entries must be owned and submitted by the Participant on their own Instagram profile.

3. Permission: By participating in the Competition, the Participants give permission for the Entries to be uploaded to www.volkswagen.ie/snapshot. Participants must also have permission from people featured in the content.

4. Copyright: Participants retain the copyright in the Entries but VW Ireland retain the right to use any of the Entries as it sees fit.

5. Staff Restrictions: The Competition is not open to VW Ireland staff (employees or contractors), their immediate family members or associated companies, including (but not limited to) the Competition’s promotional partner(s). For these purposes an “immediate family member” includes a spouse, partner, child, stepchild, grandchild, brother, step-brother, sister, step-sister, parent, step parent or legal guardian.

6. Access to Personal Data: No personal details are required from the Participants but those shortlisted will be required to share basic contact details with VW Ireland to administer the Competition. Personal information processed by the VW Ireland is subject to the Privacy Statement.

7. Expenses: All Participants are responsible for any costs or expenses incurred by them as a result of participating in the Competition.

8. The Prizes: The prizes are as stated, are not transferable to another individual and no cash or other alternatives will be offered. In the event of a prize being unavailable, VW Ireland reserves the right to offer an alternative prize of equal or greater value.

9. Prize Availability: If the winner is unavailable or unable to avail of the prize, the prize will then be awarded to the next choice. This will continue to occur until an available winner can avail of the prize. The Winner will be notified by via the account provided at point of entry within fourteen (14) days of the Winners Announcement Date to claim their Prize. It is the responsibility of the Participant to provide correct, up-to-date details on acceptance of the Prize. VW Ireland’s decision is final and binding.

10. Winner Publicity: The winner(s) agree(s) to the use of their name, their likeness and photos and will co-operate with any other reasonable requests by VW Ireland relating to any post-winning publicity.

11. Losing Prize: Failure to meet the eligibility requirements may result in forfeiture of the Prize.

12. Competition Rules: VW Ireland reserves the right at its sole discretion to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition; to be acting in violation of these Terms and Conditions; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or Participant

13. Content Policy for Photo Uploads: VW Ireland reserves the right to reject entries to the Competition at its full discretion. All Entries are subject to VW Ireland approval. All Entries that are deemed inappropriate and/or offensive will not be considered. VW Ireland’s content policy prohibits images containing nudity or sexually explicit material, or content that is otherwise deemed offensive to any minority group. VW Ireland reserves all rights to decide what is considered inappropriate and/or offensive. Participants agree not to create or submit a profile or any picture in connection with their Entry into the Competition that is: slanderous, defamatory, derogatory, or slanderous; is pornographic, or otherwise sexually explicit; includes offensive language; portrays violence; portrays or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, portrays or promotes illegal activities; portrays dangerous stunts; promotes bigotry, racism, hatred or harm against any group or individual. If VW Ireland discovers that any material submitted by Participants include any such elements or is otherwise inappropriate and/or offensive, then the Entry will be rejected. In addition, in the event that a profile or picture is determined by VW Ireland, in its sole discretion, to infringe on the intellectual property of any third party, VW Ireland may likewise reject the Entry.

14. Suspend a Participant: VW Ireland reserves the right, in its sole discretion, to remove any photos, or to deny, restrict, suspend, or terminate a Participant’s access to all or any part of the website at any time, for any or no reason, with or without prior notice or explanation, and without liability.

15. Operational Issues: VW Ireland is not responsible for any lost, late, misdirected, stolen, illegible or incomplete Entries. If, for any reason, the Competition is not capable of running as planned, caused by e.g. infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of VW Ireland which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, VW Ireland reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition and/or select winners from all eligible entries received prior to the cancellation. VW Ireland reserves the right to correct any typographical, printing, computer programming or operating errors at any time.

16. Technical Issues: VW Ireland is not responsible for any incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilised in the Competition or by any technical or human error which may occur in the processing of submissions in the Competition. VW Ireland assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. VW Ireland is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. VW Ireland is not responsible for any injury or damage to any Participant or to any computer related to or resulting from participating or viewing photos in connection with this Competition.

17. Limitation on Liability: In no event shall VW Ireland be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits damages arising from your Entry into the Competition.

18. Force Majeure: Neither VW Ireland nor any of their servants, agents, licensees shall be liable for any failure in the performance of its obligations due to factors beyond its and/or their control. In the event of unforeseen circumstances beyond its and/or their control. In the event of unforeseen circumstances beyond VW Ireland’s reasonable control, VW Ireland reserve the right to cancel, terminate, modify or suspend the Competition or these Terms and Conditions, either in whole or in part, with or without notice.

19. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the courts of Ireland shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Competition.

20. Amendments: VW Ireland may modify these Terms and Conditions and such modifications shall be effective on www.volkswagen.ie/snapshot

21. Severability: If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
